As many of you know I filed a CAP-Motors arbitration claim against PCNA re the Mobile Charger. The good news I prevailed. Now a word of caution to those thinking of doing the same. I seriously underestimated the amount of time to pursue this issue. It is not a simple process and hiring an attorney makes no sense unless you are claiming the car is a lemon and want to return it. CAP requires a lot of pre hearing forms to be completed. Then you have to prepare a brief with exhibits to prove your assertions. Then you have to prepare for the hearing itself, which means you have to prepare opening presentation, questions for cross examining witness, and finally a closing statement. Then the arbitrator will ask for closing briefs to be submitted before he renders his decision.
EXpect PCNA to hire a very experienced attorney to challenge your claims. They will object to almost every motion for discovery you need to prove your claims. They will also assert that Lemon laws do not cover issues not directly related to the car itself ( mobile charger considered accessory)
Good news if you have the time to counter their objections you will get some of your discovery approved by the arbitrator.. I figure it took me over 3 weeks and 60 hours to do this. Bottom line unless you are retired and have lots of free time don’t even consider doing this. As my wife said the only good thing out of this other than prevailing is it proves i don’t have dementia (yet).
