There is a 30% tax back credit on the Homeflex up to Dec 2021 and includes 30% off any line/socket install if needed which is pretty decent and def brigs the ChargePoint (with many more features) back close to the price point of this basic Tesla unit - now maybe there is an equal tax credit on the Tesla? - have not checked.
I think it’s form 8911 for the tex credit. I don’t see anything that would exclude the Tesla EVSE. It’s pretty generic.

I don’t think they are using smart meters yet, so they can’t throttle.
They require WiFi connected EVSEs so they can get charging data once a month.
It sounds like the utility is trying to push EV charging to off peak hours, which makes sense since most utilities have spare capacity in the middle of the night.
Smart meters are not required for this (they are required to charge you by time-of-day though). For EV throttling, what happens is that when the plant is nearing it's peak capacity, before turning on peak/overflow capacity generators to supplement, first thing they do is tell all connected EV chargers to cut their charge rates. It makes sense from the utility point of view since EV chargers are a rather large consumer, so throttling or shutting off all EV chargers in a neighborhood filled with EV's can have a large impact on the load.

You are correct about being able to claim installation of any EVSE to get the tax credit on Form 8911. WARNING: I just learned that Form 8911 is not included with H&R Block Deluxe 2021 tax software download. I've been using that version for years. May have to switch to TT for 2021.

I just take everything to an accountant every year. It’s too complicated to figure out myself.

Some of us do our own taxes. A few others have their own personal, well-worn copies of the National Electric Code. :) Now THAT is too complicated for me.
